General Terms and Conditions (GTC)

for Tai Chi & Qi Gong Courses

Courses are conducted by Marian Żóraw or by qualified instructors appointed by her.

Participants are not entitled to instruction by a specific instructor.

 

 

2. Scope

These General Terms and Conditions apply to all Tai Chi and Qi Gong courses offered by Tai Chi Roots.

 

By registering for a course, participants acknowledge and accept these Terms and Conditions as a binding part of the contract.

 

 

3. Courses and Organisation

 

The course programme includes, in particular:

  • Qi Gong

  • Tai Chi

  • Advanced Courses

 

Classes are generally held once a week.

 

Regular class times may vary depending on the course. The current course schedule and duration are set out in the respective course description on the website.

 

Courses generally run for a period of 8 to 14 weeks.

 

As a rule, no classes are held during the summer and Christmas holidays. Courses end before these holiday periods begin. Course durations are not extended to compensate for these scheduled breaks.

 

Participation in advanced courses requires appropriate prior experience. Suitability for participation is determined by the course instructor or the appointed teacher.

 

Courses begin on the fixed dates specified in the relevant course description. Depending on the date of booking, the course may begin during the statutory withdrawal period. If a course is booked within the withdrawal period and begins before that period has expired, the provisions set out in the separate Cancellation (Withdrawal) Policy shall apply with regard to services already provided in the event that the right of withdrawal is exercised.

 

 

4. Course Fees

 

Course fees are charged in accordance with the respective course description.

 

The course fee is calculated as a single amount covering the entire duration of the course.

 

The scheduled class dates published at the time of booking up to the planned end of the course are decisive.

 

 

5. Registration and Payment

 

Registration is completed via the website.

 

The course contract is concluded once:

  • your registration has been confirmed; and

  • the course fee has been paid in full.

 

The full course fee must be paid before the course begins.

 

Payment may be made using the payment methods offered through the booking system:

  • Wix Payments (credit card, debit card, Apple Pay, Google Pay, Klarna)

  • PayPal

 

Participation in the course is generally possible only after full payment has been received.

 

 

6. Right of Withdrawal, Cancellation and Non-Attendance

 

Consumers entering into distance contracts are generally entitled to a statutory right of withdrawal. Details are set out in the separate Withdrawal Policy.

 

Independently of the statutory right of withdrawal, a course booking may be cancelled in writing or by email up to seven calendar days before the course begins.

 

If cancellation is made within this period, the course fee paid will be refunded less an administration fee of €10.

 

Once the course has started, ordinary cancellation of the contract is excluded.

 

Statutory rights of withdrawal and termination remain unaffected.

 

If a participant is unable to attend individual classes - for example due to illness, holidays or other personal reasons - there is generally no entitlement to a refund or replacement class.

 

 

7. Cancellation of Classes

 

If a class is cancelled due to reasons for which the course instructor or an appointed teacher is responsible, a replacement class will be offered where possible, or the fee for the cancelled class will be refunded on a pro-rata basis.

 

If classes cannot take place due to exceptional circumstances beyond the instructor's control (such as official government measures, natural events, or comparable circumstances), a replacement class will be offered where possible or the course duration will be adjusted accordingly.

 

Participants are not entitled to a specific replacement date.

 

 

8. Participation, Health and Personal Responsibility

 

Participation in the courses is at the participant's own responsibility.

 

Participants confirm that they are generally fit to take part in the exercises.

 

Any existing health conditions, physical limitations, injuries or other circumstances that may be relevant to the safe delivery of the classes may be disclosed voluntarily to the course instructor or teacher.

 

If you have any concerns about your health, you are advised to seek medical advice before participating.

 

During classes, participants are expected to:

  • be mindful of their own physical limits;

  • stop any exercise that causes pain or discomfort; and

  • take breaks whenever necessary.

 

Tai Chi and Qi Gong are not a substitute for medical, physiotherapeutic or psychotherapeutic treatment.

 

 

9. Liability

 

The course instructor and any appointed teachers shall be liable without limitation in cases of intent or gross negligence and for damage arising from injury to life, body or health.

 

In the event of a slightly negligent breach of essential contractual obligations, liability shall be limited to the foreseeable damage typical for this type of contract.

 

In all other respects, liability is excluded to the extent permitted by law.

 

No liability is accepted for the loss, theft or damage of participants' personal belongings unless caused intentionally or through gross negligence.

 

 

10. Data Protection

 

Personal data is processed solely for the administration and organisation of our courses.

 

Further information regarding the processing of personal data—including the use of Wix, the booking system, payment processing, health data and your rights as a data subject—can be found in our Privacy Policy on the website.

 

 

11. Final Provisions

 

Any amendments to these General Terms and Conditions shall apply only to future course contracts.

 

Course contracts already concluded shall remain subject to the version of these Terms and Conditions that was incorporated into the contract at the time it was concluded.

 

The laws of the Federal Republic of Germany shall apply.

 

Should any provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
